The Italian legislation (Art. 122 of Legislative Decree no. 196/03 "Personal Data Protection Code", hereinafter referred to briefly as the "Code") introduced into our legal system EU Directive 2009/136/EC, which requires website operators using cookies or other tracking technologies to inform users of the types of cookies, if any, employed by the site.
The Order of the Personal Data Protection Authority (Garante per la protezione dei dati personali "Garante") No. 229 of 8 May 2014, published in the Italian Official Gazette No. 126 of 3 June 2014, listed cookies according to two macro-categories: 'technical' and 'profiling' cookies.
• Technical cookies.
Technical cookies are those used for the sole purpose of "carrying out the transmission of a communication over an electronic communications network, or to the extent strictly required for the provider of an information society service explicitly requested by the subscriber or user to provide such a service"
