1 GENERAL CONDITIONS
General Conditions of Sale applicable to on-line purchases on the Felicia Shop website.
Andriani SPA with local and administrative headquarters in Via Nicolò Copernico s.n. – Zona PIP 70024 - Gravina in Puglia (Ba) Italy – VAT No. 06880780728 – Tel. 080 3255801 – REA Company Reg. No.: Bari n. 584837 (hereinafter “Felicia Shop”), as authorised retailer, allows all users to purchase the products offered on the Internet (hereinafter the “Products”) via the shop.glutenfreefelicia.com website (hereinafter the “Site”), which it owns exclusively.
1.1 GENERAL NOTES
These General Conditions of Sale are regulated by the Consumer Code (Legislative Decree 206/2005), section II, Remote Contracts (articles 50-67), as modified by Directive EU 2011/83 implemented by Legislative Decree of 3 December 2013 and e-commerce regulations (Legislative Decree 70/2003), and apply to the on-line sale of the Products, as identified and listed on the Site. The Customer is advised to print or use their preferred method to save these General Conditions.
In the event of any amendments, the General Conditions applicable to an order (hereinafter “Order”) shall be those published on the website at the time the Order was submitted by the Customer. By submitting an Order, the Customer declares to have read, understood, and accepted these General Conditions.
1.2 OFFER TO THE PUBLIC
The Products and the prices shown on the Site constitute the offer to the public, as provided by the General Conditions and published on the Site. The Conditions of the offer apply exclusively to the purchases made on the Site.
Purchase contracts (hereinafter the “Contracts”) stipulated on the Site are stipulated with Andriani SPA.
Delivery charges shall be met by the Customer, as clearly indicated in the Order, and as specified in the Shipping and Delivery section of these General Conditions.
The prices applicable to the Products are those published on the Site at the time the Order is submitted. Any previous offers or subsequent price variations shall not be applicable.
1.4 PRODUCT REPRESENTATION
The images, descriptions, and how-to-use instruction of the Products published on the Felicia Shop website are purely illustrative and nonbinding.
The visual representations on the Site, where available, are usually photographic images of the Products and/or their packaging. These images serve solely the purpose of presenting the Products for sale and Andriani SPA does not guarantee that the images shown on the Site corresponds exactly to the actual Products.
In the event of any discrepancies between the image and the description on the information sheet of the Products, the latter always prevails.
4 CANCELLATION RIGHTS AND REGULATIONS
In compliance with the applicable laws, Felicia S.r.l. gives Customers a period of 14 days to cancel on-line purchases and return the goods without penalties and without providing a reason.
4.1 HOW TO CANCEL
The 14 days to cancel an Order start from the date on which the Customer, or a third party appointed by them, with the exception of the courier, received the purchased goods, or (in the case of purchases involving multiple products that the Customer has included in a single order and have been sent separately), from the day in which the last purchased product was received.
To cancel an Order, within the 14-day deadline, the Customer may:
a) Use the Return Form downloadable from the following link: Download Return Form; or
b) Send Felicia S.r.l. any explicit written notification expressing the intention to cancel the Order, via recorded mail, to Via Nicolò Copernico s.n. zona PIP, 70024 - Gravina in Puglia (BA), Italy, or via certified email (PEC) to firstname.lastname@example.org, or via fax to +39 080.322.13.04
4.2 HOW TO RETURN GOODS
When Customers cancel an Order, they must return the goods within 14 days from the date on which they notified Felicia S.r.l. of their intention to cancel the Order, as prescribed by article 57 of Legislative Decree No. 206/2005.
Goods must be returned to Felicia S.r.l., via Nicolò Copernico s.n., zona PIP, 70024 - Gravina in Puglia (BA), Italy.
Direct return costs shall be met entirely by the Customer.
Products must be returned undamaged and in perfect conditions, inside their original packaging, and with no parts missing (internal packaging, documents, and accessories) with any fiscal documentation enclosed.
Without prejudice to the right to verify the above, in particular the condition of the returned goods, Felicia S.r.l. shall refund the price of the returned Products, including any delivery charges applied at the time of purchase, within 14 days from the date on which it received the returned Products from the Customer. Felicia S.r.l. is not required to refund any additional delivery charges, if the Customer chose a delivery method other than the cheaper method indicated by Felicia S.r.l.
Felicia S.r.l. will process the refund using the same payment method chosen by the Customer to make the purchase. If the Customer made the purchase via bank transfer, they will have to provide Felicia S.r.l. with their bank details: IBAN, SWIFT and BIC required by Felicia S.r.l. to process the refund.
If the recipient of the Products shown on the Order form is not the person who made the payment, the refund will be made to the person who made the payment.
